Summary

DAI-Prosecutes misdemeanor caseloads. Reviews police reports and requests follow-up investigations as necessary; charges offenses by information or indictment. Performs intake duties with other attorneys from submission of reports by police, to final resolution; Drafts legal documents such as motions, orders, memoranda, diversion agreements, and search and arrest warrants with supporting affidavits.

DAII-Prosecutes misdemeanor and felony caseloads with special emphasis on domestic violence and sexual assault. Reviews police reports and requests follow-up investigations as necessary; charges offenses by information or indictment. Performs intake duties with other attorneys from submission of reports by police, to final resolution; Drafts legal documents such as motions, orders, memoranda, diversion agreements, and search and arrest warrants with supporting affidavits.

DAIII-Prosecutes major felony caseload, including sex crimes, from submission of reports by police, to final resolution; participates in County Multidisciplinary Team (MDT); handles juvenile cases involving child abuse. Deputy District Attorney's work and serve at the discretion and will of the District Attorney.
Essential Duties and Responsibilities

The following may not be all inclusive and other duties may be assigned.

DAI-

01 Reviews police reports and requests follow-up investigations as necessary; charges offenses by information or indictment. Performs intake duties on a rotational basis with other attorneys.

02 Drafts legal documents such as motions, orders, memoranda, diversion agreements, and search and arrest warrants with supporting affidavits.

03 Participates in case negotiations with defense attorneys which involves analyzing the case to determine its overall strength, evaluating the number and kinds of witnesses available and determining what resolution is appropriate.

04 Prepares for hearings and trials in Circuit Court by reviewing reports, legal issues and physical evidence surrounding the case, identifying and interviewing witnesses, conferring with police officers and preparing trial notes.

05 Appears in Court to represent the State by presenting evidence and argument at arraignments, preliminary hearings, and pretrial conferences, hearings on motions, trials, sentencings, and Grand Jury proceedings.

06 Conducts legal research necessary for case preparation; keeps abreast of Court decisions and legislation affecting the Oregon Criminal Code.

07 Pursuant to ORS 8.780, each Deputy DA shall have the same qualifications as the District Attorney, and subject to the direction of the District Attorney, has the same functions as the District Attorney. Deputy District Attorneys shall serve at the direction and discretion of the District Attorney and shall perform any and all job functions assigned by the District Attorney.

08 Responsible to demonstrate the conduct and behavior of a team player by helping create a professional and rewarding work environment for all District Attorney Employees.

08 Serves as a prosecutor for primarily felony offenses, and may occasionally be required to prosecute some misdemeanor cases.

Deputy District Attorneys shall serve at the direction and discretion of the District Attorney and shall perform any and all job functions assigned by the District Attorney.

DAIII-

03 Prepares for hearings and trials by reviewing reports, legal issues and physical evidence surrounding the case, identifying and interviewing witnesses, conferring with police officers and preparing trial notes.

04 Appears in court to represent the State by presenting evidence and arguments at arraignments, preliminary hearings, pretrial conferences, hearings and motions, trials, sentencings, and Grand Jury proceedings.

05 Conducts legal research necessary for case preparation; maintains thorough knowledge of Court decisions and legislation affecting the Oregon Criminal Code.

06 Participates in case negotiations with defense attorneys; involves analyzing the case to determine its overall strength, evaluating the number and kinds of witnesses available, and determination of the most appropriate solution.

07 Pursuant to ORS 8.780, each Deputy DA shall have the same qualifications as the District Attorney, and subject to the direction of the District Attorney, has the same functions as the District Attorney. Deputy District Attorneys shall serve at the direction and discretion of the District Attorney and shall perform any and all job functions assigned by the District Attorney.

09 Prepares for prosecution of major cases including homicide, sex crimes, serious assaults, and others that require an experienced prosecutor.

10 Work under the direct supervision of the District Attorney and preform duties as directed by the District Attorney.

Education and/or Experience

DAI-Graduation from accredited school of law; with experience in the criminal law field preferred. Must be a member in good standing of the Oregon Bar at the time of appointment. Experience prosecuting criminal offenses including DUII and misdemeanor assaults, thefts, etc., and felony cases. Experience in prosecuting domestic violence/sexual assault cases, both felony and misdemeanors.

DAII-Doctoral degree or equivalent; or more than 10 years related experience and/or training; or equivalent combination of education and experience.

DAIII-Graduation from accredited school of law; with experience in the criminal law field preferred. Must be a member in good standing of the Oregon Bar at the time of appointment.
